The LawSociety Gazette recently published the article below about a new mediation service the NHS litigation Authority has just launched in partnership with the Centre for Dispute Resolution.What do you think about this in relation to the type of disputes the NHS encounters. 

NHS offers mediation service to avoid court

In partnership with the Centre for Dispute Resolution, the service will offer a face-to-face discussion between the healthcare provider and the patient, supported by an independent and accredited mediator.

During the process, legal rights remain intact and either party can proceed to court if they are unhappy with the outcome.

The litigation authority says the scheme will be an independent and voluntary process for resolving claims against health authorities.

Chief executive Catherine Dixon (pictured) said: ‘We hope that it will help patients, their families and NHS staff resolve concerns quickly and cost-effectively whilst also enabling all the parties to meet to have their say without the need to go to court.’

Comment and Debate: Peer Review Mediation

Here is a fairly new article on peer review mediation and the benefits it might present to conflict resolution. Any thoughts?

The cutting edge commands performance that stresses participants and can lead to sour notes in the symphony’s concerto. How can we all get along? Perhaps a type of peer review mediation.

The push for prominence on the job creates regular opportunities for conflict to arise, especially with the youthful employees who lack maturity. Like communication conundrums in learning organizations, conflict is an enigma when it comes to transforming it into learning for the organization. Commanding responsiveness of employees only works temporarily and leads to subversive behavior.

Perhaps a fresh approach may give you, the leader or business professional, additional arrows in your quiver to reduce your capacity to sin in change management. Hitting the mark with a tool that allows learning through resolution mitigates mayhem and applies the wisdom of translational leadership. Anyone who has involvement in the end product of any process is a stakeholder.

Peer-based Conflict Resolution

Facilitating the empowerment of stakeholders is the number one task. Developing a peer-based community within the workplace that reduces downtime through effective communication and education of conflict resolution, applied to individual and group environments, is understood to be a primary goal. It is an element of change.

Peer mediation processes have been proven to be effective when stakeholders are trained in the art. There are several reasons that peer mediation implementation would benefit an organization, stakeholders and clients. The objective is to create a collaborative environment that adapts easily. Happy people get more done with less supervision, often to the surprise of management.

BACKGROUND:

16th October 2014 is World Conflict Resolution Day and this is our twelfth annual “Developing Mediation Conference.” 2014 is also the 20th Anniversary of the Year of the Family – www.family2014.org – and we are building on last year’s very successful theme of “Children and Young People at the Centre” by taking it a stage further –looking at the active contributions of young people in helping to resolve conflicts in the family and in their peer group at school or college.  This unique event seeks to combine the expertise of mediators, teachers and young people in both family and peer mediation, to see what insights and strategies we can share and especially how young people can themselves be participants in the resolution of conflict. Our courses always provide an opportunity for a fresh look at our work through conversation; you can help us by encouraging colleagues from all professions concerned with the empowerment of young people in situations of family or peer group conflict to come along and participate.

 

Hosts and Facilitators: Lisa Parkinson is a family mediator, trainer, PPC (professional practice consultant) and a founder and Vice-President of the Family Mediators Association (FMA). We aim to look at young people as active participants in conflict resolution through different filters:

  • Duncan Fisher, Kids in the Middle will talk about online peer mentoring for children and young people experiencing parental separation and divorce and we will share ideas and experiences concerning resources and services provided by young people themselves
  • Carol Hope, one of the UK’s leading experts on peer mediation will talk about ‘Peer mediation  – active learning process’ and will provide insights into the training and experience of peer mediators in schools and colleges
  • Our Biennial International Round Table: mediators from  eight countries will share experiences of working – directly or indirectly – with children and young people experiencing parental separation and divorce and their contributions to family conflict resolution
  • As ever, we will work in groups to discuss how mediators of all generations can work together more closely to  share and develop  our skills in conflict management  and incorporate this learning in our existing practice

LEARNING OUTCOMES:

  • Explore how young people may themselves initiate and manage the resolution of family and other conflict
